This Terms of Use Agreement (the “Agreement”) constitutes a legally binding agreement by and between BlazeBoosts, a business entity organized under the laws of The Gambia (“BlazeBoosts”), and the client, whether personally or on behalf of an entity (“Client”), with regard to access and use of BlazeBoosts’ website: www.BlazeBoosts.com (the “Website”) and any other media form, channel, mobile website, or mobile application related, linked, or otherwise connected thereto. Failure to agree and adhere to all of the terms, conditions, and obligations contained herein results in the express prohibition of the Client’s use of the Website, and the Client is ordered to discontinue use immediately. Thereafter, the relationship between Client and BlazeBoosts shall cease and be of no further force and effect, except that any obligation of Client to pay BlazeBoosts for services rendered shall remain and continue to be an ongoing obligation owed by Client to BlazeBoosts.

1. Intellectual Property Rights

Unless otherwise indicated, the Website is the property of BlazeBoosts. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics of any nature, regardless of format (collectively, the “Content”), and the trademarks, service marks, and logos contained there (the “Marks”) are owned and controlled by BlazeBoosts and are protected by copyright, trademark, and intellectual property laws of The Gambia, foreign jurisdictions, and international conventions. The Content and Marks are provided “As-Is” for your information and personal use only. Except as expressly provided herein, no part of the Website and no Content may be copied, reproduced, aggregated, republished, uploaded, posted, displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without BlazeBoosts’ express prior written permission. BlazeBoosts reserves all rights to the Website, Content, and Marks.


2. Ownership of Materials

All projects, deliverables, and original source files created on the Client’s behalf (“Projects”) will remain the property of BlazeBoosts until the Client has fully paid all setup and subscription fees as outlined in the Service Agreement. BlazeBoosts retains ownership of the Projects during the subscription period and grants the Client a limited, non-exclusive license to use the Projects during that time.

Once full payment has been received, including the complete payment of both setup and subscription fees, ownership of the Projects, including any rights, will be transferred to the Client. BlazeBoosts reserves the right to showcase design work on its digital channels (e.g., social media, Website) unless otherwise agreed upon as stated in Section 18 of this document.


3. Third-Party Fonts and Resources

If any Project incorporates third-party fonts or resources that BlazeBoosts does not own and requires a commercial license, BlazeBoosts will notify the Client in writing. The Client will be responsible for purchasing any necessary permits for the legal use, reproduction, or public display of these third-party elements. BlazeBoosts assumes no responsibility for any consequences resulting from the Client’s failure to acquire the necessary licenses.


4. Client Representations

By using the Website, the Client represents and warrants that:

  • The Client has the legal capacity to comply with these Terms of Use;
  • The Client is not a minor in their jurisdiction;
  • The Client will not access the Website through automated or non-human means;
  • The Client will not use the Website for any illegal or unauthorized purposes;
  • The Client’s website use will not violate any applicable law or regulation.

5. Prohibited Activities

The Client agrees not to use the Website for any purpose other than what is expressly permitted in the agreement. Prohibited activities include but are not limited to:

  • Making unauthorized use of the Website;
  • Retrieving data or content to create a database or directory;
  • Circumventing or interfering with the WWebsite’ssecurity features;
  • Engaging in unauthorized framing or linking of the Website;
  • Engaging in fraudulent or deceptive behavior;
  • Using the Website in a manner that violates any applicable law or regulation.

6. Client Feedback

Client feedback, including questions, comments, or suggestions (collectively “Feedback” shall be the sole property of BlazeBoosts. BlazeBoosts is not obligated to keep the Feedback confidential or compensate the Client for the Feedback unless otherwise agreed. BlazeBoosts reserves the right to use and disseminate such Feedback at its discretion.


7. Management and Oversight

BlazeBoosts reserves the right to monitor the Website for violations of these Terms of Use and take any legal action necessary to respond to violations. BlazeBoosts reserves the right to restrict or terminate access to the Website at its sole discretion.


8. Privacy Policy

Using the Website, the Client agrees to be bound by BBlazeBoosts’Privacy Policy. The Client consents to transferring and processing data in The Gambia as needed. BlazeBoosts does not knowingly collect data from individuals under the age of 18. In compliance with relevant laws, BlazeBoosts will delete any personal information received from minors without parental consent as soon as reasonably practical.


9. Returns and Refunds

BlazeBoosts reserves the right to deny refunds at its sole discretion. Requests for refunds will be evaluated on a case-by-case basis. If a refund is approved, a 25% fee may be deducted from the remaining balance. If a refund is issued within the first month of service, BlazeBoosts retains ownership of all materials and deliverables created, and the Client cannot use them.


10. Modification of Website and Terms

BlazeBoosts reserves the right to change or modify the Website or these Terms of Use at any time, with or without notice. Continued use of the Website constitutes acceptance of any modifications made.


11. Connection Interruptions

BlazeBoosts does not guarantee that the Website will be accessible at all times. Technical issues beyond BBlazeboosts’ control may result in interruptions. BlazeBoosts is not responsible for any loss or damage caused by connection interruptions.


12. Governing Law

These Terms of Use shall be governed and construed by the laws of The Gambia without regard to conflicts of law principles.


13. Litigation

Any disputes arising out of or related to these Terms of Use shall be resolved in the courts of The Gambia. The parties hereby consent to the jurisdiction of said courts and waive all defenses of lack of personal jurisdiction and venue.


14. Disclaimer

The Website is provided on an “as-is” and “s-available” basis. BlazeBoosts makes no warranties or representations regarding the WWebsite’saccuracy, completeness, or availability. BlazeBoosts disclaims all warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.


15. Limitations of Liability and Indemnification

BlazeBoosts and its directors, employees, and agents shall not be liable for any direct, indirect, incidental, or punitive damages arising from the CClient’suse of the Website. The Client agrees to indemnify and hold BlazeBoosts harmless from any claims arising from their use of the Website or breach of these Terms of Use.


16. User Data

The Client is responsible for all data transmitted or related to their activity on the Website. BlazeBoosts is not liable for any loss or corruption of data, and the Client waives any claims against BlazeBoosts for such loss or corruption.


17. Electronic Communications and Signatures

Using the Website, the Client consents to receive electronic communications from BlazeBoosts. The Client agrees that any electronic communication, including emails and electronic signatures, satisfies legal requirements for written agreements.


18. Showcasing Design Work

BlazeBoosts reserves the right to showcase design work on digital platforms (e.g., social media, Website) unless otherwise agreed. If requested, BlazeBoosts will sign a non-disclosure agreement (NDA) to protect the confidentiality of the project.


19. Referrals

BlazeBoosts may use third-party services to track referrals and manage payouts. Referral tracking details will be outlined as necessary with any applicable third-party platform.


20. Miscellaneous

These Terms of Use constitute the agreement between the Client and BlazeBoosts. If any part of these Terms of Use is found to be unlawful or unenforceable, the remaining provisions will remain in effect.
